ORDER
NO.
04-93
WHEREAS,
the
Institute
of
Medicine
has
estimated
that
medical
mistakes
cause as
many as
98,000
preventable
deaths
in the
United
States
each
year;
and
WHEREAS,
the
costs of
healthcare
are
escalating
at
alarming
rates
while
the
nation's
demographics
are
placing
greater
demands
on the
healthcare
system;
and
WHEREAS,
in the
absence
of an
effective
system
for
sharing
medical
information
among
the
provider
community,
healthcare
providers
are
forced
to order
costly
duplicative
medical
tests
and
procedures;
and
WHEREAS,
the
healthcare
system
would
benefit
from
reducing
the time
it takes
to
evaluate
promising
medical
techniques,
devices
and
drugs,
and
bringing
the
products
and
procedures
that are
proven
safe and
effective
to the
healthcare
marketplace
more
quickly;
and
WHEREAS,
providing
consumers
with
online
access
to
computer-based
tools
that
gather
data
from
their
medical
records
and
assist
in
interpreting
and
monitoring
the data
in
conjunction
with
their
healthcare
providers
would
permit
them to
become
better
informed
and more
proactive
in
managing
their
health
and
wellness,
thereby
reducing
utilization
and
adding
efficiencies
to the
healthcare
system;
and
WHEREAS,
with the
advances
made in
information
technology
and
network
computing,
it is
feasible
to
implement
in the
state an
effective
health
information
infrastructure
capable
of
drawing
together
critical
health
information
from
multiple
sources
and
presenting
that
information
to
authorized
parties
in a
usable
format
to
support
sound
decisions
about
health
by
providers,
consumers,
public
health
officials
and
researchers,
when and
where
needed;
and
WHEREAS,
such a
health
information
infrastructure
is a
necessary
and
important
part of
effectively
addressing
the
challenges
and
opportunities
referred
to
above;
and
WHEREAS,
ensuring
the
privacy
and
security
of
personal
health
information
is of
great
importance
to and
in the
best
interests
of the
people
of the
State of
Florida,
and
WHEREAS,
the
creation
and
promotion
of a
cohesive
and
workable
plan for
the
development
and
implementation
of a
Florida
health
information
infrastructure
is of
vital
importance
to, and
in the
best
interests
of, the
people
of the
State of
Florida.
NOW
THEREFORE,
I, JEB
BUSH,
Governor
of the
State of
Florida,
by the
powers
vested
in me by
the
Constitution
and laws
of the
State of
Florida,
do
hereby
promulgate
the
following
Executive
Order,
effective
immediately:
Section
1.
-
There
is
hereby
created
the
Governor's
Health
Information
Infrastructure
Advisory
Board
("Advisory
Board")
which
shall
be
advisory
in
nature.
-
The
Advisory
Board
shall
be
composed
of
eleven
members,
to
be
appointed
by
the
Governor.
Membership
shall
include
representatives
of
the
provider
community,
information
technology
experts
and
health
care
policy
experts.
-
W.
Michael
Heekin
shall
serve
as
Chair
of
the
Advisory
Board.
-
The
members
shall
receive
no
compensation,
but
shall
be
entitled
to
per
diem
and
travel
expenses
while
attending
meetings
of
the
Advisory
Board
and
otherwise
on
official
Advisory
Board
business,
to
the
extent
allowed
by
Section
112.061,
Florida
Statutes.
Section
2.
-
The
Advisory
Board
shall
advise
and
support
the
Agency
for
Health
Care
Administration
("Agency")
as
it
develops
and
implements
a
strategy
for
the
adoption
and
use
of
electronic
health
records
and
creates
a
plan
to
promote
the
development
and
implementation
of a
Florida
health
information
infrastructure,
including
measures
to
promote
greater
adoption
of
electronic
health
record
information
systems
among
the
state's
healthcare
providers;
-
The
Advisory
Board
shall
identify
obstacles
to
the
implementation
of
an
effective
health
information
infrastructure
in
the
state
and
provide
to
the
Agency
policy
recommendations
to
remove
or
minimize
those
obstacles;
-
The
Advisory
Board
shall
advise
appropriate
parties
within
the
Executive
and
Legislative
branches
on
issues
related
to
the
development
and
implementation
of
the
health
information
infrastructure.
-
The
Advisory
Board
shall
assist
the
Agency
in
ensuring
that
the
strategy
and
plan
preserve
the
privacy
and
security
of
health
information,
as
required
by
state
and
federal
law.
Section
3.
The
Advisory
Board
shall
act by a
vote of
the
majority
of its
members.
A quorum
of at
least
seven
(7)
members
shall be
required
for an
act of
the
Advisory
Board to
have
effect.
No
member
may
grant a
proxy
for his
or her
vote to
any
other
member
or
member
designee,
except
with the
prior
approval
of the
Chair.
The
Governor
will
fill by
appointment
any
vacancy
on the
Advisory
Board.
Section
4.
The
Agency
shall
provide
staff
support
to the
Advisory
Board
and may
enter
into
contracts
as are
necessary
or
proper
to carry
out the
provisions
and
purposes
of this
order to
support
the
Advisory
Board in
the
performance
of its
duties.
In
addition,
all
agencies
under
the
control
of the
Governor
are
directed,
and all
other
agencies
are
requested,
to
render
full
assistance
and
cooperation
to the
Advisory
Board.
Section
5.
The
Advisory
Board
shall
continue
in
existence
until
all of
its
objectives
are
achieved,
but no
later
than
June 30,
2007,
unless
extended
by
future
Executive
Order.
Section
6.
In
addition
to
serving
as Chair
of the
Advisory
Board,
W.
Michael
Heekin
shall
serve as
senior
policy
advisor
on the
issues
named
herein,
acting
in an
advisory
capacity
to the
Governor
and to
the
Secretary
of the
Agency.
